What is a deposition?

I'm Herb Friedman of Friedman Law Offices in Lincoln, Nebraska. If you file a lawsuit, sooner or later the opposing attorney is going to want to take your deposition. A deposition is part of the rules which give all parties the right to discover the facts, and is basically a question and answer session under oath before a Court Reporter, which is then transcribed. Depositions these days are also frequently video-taped. Your lawyer and the lawyer for the other party are present during the deposition, and the other lawyer will ask you a series of questions concerning your case. Your deposition is the most important part of your case. The testimony you give in a deposition can be and usually is used in the trial of your lawsuit. Your lawyer will spend time with you before the deposition in order to help you prepare.
