SSDI

Nebraska SSDI Claims Attorneys

Most people are initially denied Social Security disability or Supplemental Security Insurance Disability benefits and are left to deal with the challenges of supporting themselves without the ability to work due to physical injuries or mental handicaps. Friedman Law Offices has successfully advocated on behalf of the disabled against the Social Security Administration for clients throughout Nebraska. With regard to claims for Social Security benefits, other than retirement, there are several levels of appeal if you are initially denied. There are also time limits that must be followed otherwise a new application must be filed and you can lose back benefits. Friedman Law Offices handles handle both types of Social Security disability claims at all stages of the claim, including the initial application, reconsideration, hearings in front of Administrative Law Judges or further levels of appeal. We obtain the necessary medical records and reports to help establish your disability.

Essentially, disability means an inability to engage in any substantial gainful activity for any reason because of a medically determined physical or mental impairment which can be expected to last or has lasted for a continuing period of not less than 12 months or that will result in death. To be considered disabled, you can either have a single physical injury or mental condition or a combination thereof. The Social Security Administration also examines your physical and mental conditions, your education, age and experience. The experienced attorneys at Friedman Law Offices understand Social Security disability law, what evidence is necessary to establish disability, and the ability to obtain this evidence.

There are two types of benefits relating to Social Security disability. Social Security disability benefits (SSD) may be available to disabled people who have engaged in work activities over a good portion of their life and have worked approximately five of the last 10 years. Supplement security income benefits (SSI) apply to people who are disabled, but do not have a significant work history and have not paid sufficient money into Social Security to qualify for SSI benefits.

Social Security disability benefits are also available to children with disabilities or widows.

Generally speaking, federal law and regulations governs the fee we can collect for representing a disabled person. In most cases, the attorney fee is 25% or $5,400, whichever is the lower amount. This only applies to back benefits, that is, benefits due from the time you became disabled until the Social Security Administration acknowledges your disability. We cannot take a fee for future benefits.
